University Gun Free Zone
This is an imaginary conversation with a stupid person. This type of stupid person hasn't fully manifested in NJ because NJ is one big gun free zone. I'm withholding the identity of the stupid person. They might read this and think, wow that other guy is stupid. How stupid is that.
Unrealistic Firearm Phobic Person:
I want to ban guns from our universities.
Normal Human:
Really, how come?
Unrealistic Firearm Phobic Person:
Universities are places of learning and we do not want to teach the wrong things to students.
Normal Human:
Like what?
Unrealistic Firearm Phobic Person:
Well, that guns are a normal thing because they are not.
Normal Human:
Last year the FBI did something like 15 million FBI background checks for gun purchases, that sounds normal to me.
Unrealistic Firearm Phobic Person:
But guns aren't safe and we don't want them in schools.
Normal Human:
So what is it that you really want?

I want to make colleges gun free safe zones.

Is that your end game, to make guns go away on campus?

That's silly, you can't arrest someone before they commit a crime, this is America.

OK, you're trying to make a gun free zone with a law. A bunch of words on paper that only law abiding citizens will obey. The criminals and crazy people disregard the words on the paper because, well, criminals break the law. No surprise there. And crazy people do crazy things. I guess because they're crazy.

2nd Amendment v. Stupid NJ Gun Laws - The 1st Court Opinion (even more more critique)
As said when this Opinion began, the Second Amendment is unique among the enumerated constitutional rights because it permits the use of a lethal weapon by one person who rightly or wrongly may cause serious personal injury – including the ultimate injury of death – to another person. The inherent risks associated with the public exercise of that right require this Court to carefully analyze the self-described limited scope of Heller.
So says gun fraidy cat Justice William H. Walls. Let's assume for a minute that "self defense" became a valid justifiable need to get a carry permit in NJ. What would happen? According to Bill here, the streets would be occupied with folks "rightly or wrongly" shooting up the place. Did that just happen in Wisconsin? Freedom reared its ugly head for dangerous cheese heads. No blood in the streets. Aren't those crazy Packers fans out of control and unable to make grownup decisions? Hummm.
Billy works in a dangerous city overrun with murder, drugs and general mayhem. What happens in Newark once the floodgates of freedom swing open? Does Billy think that felons, gang bangers, drug dealers, car jackers, pimps, prostitutes, home invaders, rapists and similar bad guys will suddenly march down to city hall and apply for permits? Let's say in his wildest imagination that this really happens. My God, all these dangerous people are now armed! Well many of them already are so what's your point Bill? Oh, you're worried about the unarmed criminals who will now run out and get a carry permit because NJ lowered its standard? Again, let's assume that some dangerous guy is so stupid he could not buy a handgun illegally. This is a stretch but suppose further that he applies for a FPID, a PPP and a carry permit. What are the chances that said criminal would pass the background check? When you look at it that way the judge's logic is brain dead.
As a tool for picking up criminals, maybe easing up the permitting requirements will help police. Imagine the flood of people presenting themselves for a permit only to be swooped up for priors. That might work. What we really need to find out is who are all these people who would begin carrying guns outside the home. Let's think.

NJ loves its paperwork and endless bureaucracy so who would actually get a permit to carry a handgun? Well it would be someone who already has a handgun and that is a challenge all by itself. It could take months for the town to issue your freedom pass. How about the equally difficult application process to get a carry permit. So who exactly will pay all the fees, fill out the endless paperwork and wait months for a carry permit? Does Billy think that criminals and violent people will do this? The guy or gal who goes to all this trouble is somehow a threat to society because . . .

Law abiding folks just want to protect themselves from the guys that you guys keep setting free. The Handgun Permit Law is also not facially unconstitutional as a prior restraint because this framework does not apply in the Second Amendment context and the challenged provisions do not vest uncontrolled discretion to state officials.
Oh really. So when someone wants a carry permit in NJ, a judge doesn't have 100% control over your request? Does Justice William H. Walls think that our process here is somehow not uncontrolled? Billy, please. And since when does a judge become an issuing authority in any other circumstance? Aren't permits and licenses kinda a town clerk sort of thing? Hi I'd like to get a dog tag for Spot. OK, the judge will see you in his chambers.

2nd Amendment v. Stupid NJ Gun Laws - The 1st Court Opinion (more critique)
Because Heller was the Supreme Court’s “first in-depth examination of the Second Amendment,” he wrote that “one should not expect it to clarify the entire field . . . .” He did emphasize that “the right was not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose.” If the Supreme Court majority had intended to create a broader general right to carry for self defense outside the home, Heller would have done so explicitly.
The “he” that Judge William H.Walls refers to in his masterpiece opinion is Justice Antonin Scalia of the Supreme Court of the United States. You may have noticed the picture of Judge Billy from a previous post. I'll go out on a limb here and say that he's probably not a descendant of those pesky Europeans who founded our nation. Likewise, it may be safe to say none of his relatives signed the Constitution or Bill of Rights. That's not to say someone from his bloodline wouldn't have been qualified. Hell, Billy is a Federal Judge. I'm just saying that he and his ancestors would not have been part of that clique. Regrettably, if his family were around at that time, chances are they'd be part of the help and not the hired ones. So what's the point?
Billy seems to think that because the highest court in the land did not specifically rule on whether the 2nd Amendment applies outside the home, that he's not going to do it either. So there, what are you going to do about it? So what if the plain meaning of the amendment is clear. So what if the 2008 opinion mentions what "to bear" means, it only ruled on "inside the home" and my pea size brain can't (won't) take it to the logical conclusion. OK, fine. Being as you come from a people who were denied basic human rights, might you have a soft spot for justice?
Can you imagine a time when someone wouldn't let you eat in a certain diner? You're old enough to have lived through a time when someone could legally deny equal access to public accommodations. Sorry, you go to your side of town until the court says otherwise. How about riding at the front of the bus? How about voting? No, the court never said anything about your kind, move along. Did you like it when you had to go to an all black school? Well you knew that all this was wrong. Because the Constitution and the Bill of Rights never specifically mentions skin color, does that mean that none of it applied to you? Was that somehow fair or just?
Bill, did you know that the wonderful concept of gun control has its roots in racism. Those fun loving KKK guys and you share a common bond. Yeah, that's right. Go read Justice Clarence Thomas's opinion in McDonald v Chicago which begins on page 67. He does a wonderful job explaining the whole thing. What you've done in your court is deny my civil rights. It is no less egregious in the legal sense than what was done to your ancestors. The fundamental God given right to self defense outside the home is for all races in NJ and you've poopoo'ed it all away. Why? Because the Heller & McDonald rulings only mentioned it in dicta. You should be ashamed of yourself.

Do you think a federal circuit judge can think for himself or does he have to be told what to think? When there's a Constitutional civil right case before the lower courts, why do these guys kick it down the road? Do we really have to wait years for a simple matter to be decided because of the frail egos of judges? God forbid they get overturned on appeal. No balls.
A more glaring deficiency is how easy personal ideology factors in. Some people have an agenda, as do I. The big difference is they are wrong and I am right. Also, they know I'm right yet they cling to the last vestiges of their utopia, hoping for a miracle. They'll stall for as long as possible, like a child negotiating those last precious minutes before bed time. Sad yet pathetic.
On January 12th, United States Senior District Judge William H. Walls handed down his opinion of the civil law suit I like to call the 2nd Amendment v. Stupid NJ Gun Laws. I think everyone knew how he would decide and no one should be surprised. Judge Wall was a Clinton appointee and a NJ native. He spent his whole legal career in NJ. The guy has the proper credentials for squashing the 2nd Amendment. And squash it he did.
Billy is a mere stepping stone on our way to freedom. Not being a constitutional lawyer myself, I still see some gems in his opinion that should be used on appeal. When these guys say or write dumb stuff it should always come back as a Stooges poke in the eye. Billy quotes some 1970's case that probably sums up the whole game plan of idiot lawmakers & dumb judges.
Well isn't that great. These guys don't want us to use guns. Why? Because they are dangerous and it's a “reasonable determination that limiting the use of guns leads to fewer incidents of gun-related injury and death.” What a genius. At least we have it it writing now. That is the actual reason for all the dumb gun laws according to Walls. I'd circle back to that one for sure on appeal.
I guess the state should also have some sort of compelling interest in automotive safety. They can limit who gets to drive a car? Wait, don't I have to just pass a written, vision and driving test while meeting an age requirement in order to get a driver's license? I don't recall having to go before the chief of police and then a judge to explain the reason why I need to drive. Driving, walking or riding a horse isn't even mentioned in the Bill of Rights yet no municipality in the USA has a “justifiable need” clause in their licensing scheme. Yet, don't evil SUV's kill? How many people die each year in the Garden State at the hands (wheels) of dangerous vehicles and the tires they ride on? Could you imagine Billy having to defend some law that limits driver's licenses on the grounds that drivers may kill someone with a Ford. Classic.
I'll be deconstructing Billy's opinion for the fun of it in future posts. It really doesn't matter what dummy thinks. He's a footnote in this whole process. This is all about me having some fun with his 46 page masterpiece.

I'll See Your Handgun & Raise it a Nuclear Missile
Ethnic and religious Jews are probably a good a group as any to stand for something. Having suffered the consequences of disarmament and general bigotry for ages, they appear qualified to have a meaningful opinion, don't you think? A fine example is an article written by Charles Heller, Executive Director, JPFO called "Reflections on a Terrible Day".
Mr. Heller's organization Jews for the Preservation of Firearm Ownership pretty much sums up their position right there in the title. One of the points of the piece is that crazy is crazy and it's crazy to disarm the non-crazy. Another is that there is no such thing as a gun free zone, only a target rich environment for crazy, criminal, tyrants or any combination thereof. What nuclear power has ever relinquished their arsenal in total with the hope that a nuclear free zone will make them safer? Israel supposedly has a bomb or two, does anyone think they could disarm and then live happily ever after with the Arab world?
How about us, the USA. Should we sell the rest of our ICBM's on eBay so that the world can finally live in peace? Probably not. Take the analogy down a few notches and ask why should individuals a). give up their firearms & b). live in gun free zones. Answer, crazy people exist. As long as there are people that will impose their evil will on the innocent, the innocent must be allowed to be armed.

Let's Return to Our Constitutional Roots
Here's a novel idea, law enforcement officers upholding the Constitution. I'm not sure if PD's even have that as part of the swearing in ceremony anymore. The "repeat after me" might be some lawyer-speak or don't-offend pablum.
A Sheriff Brad Rogers of Elkhart County, Indiana is a brave soul who is requiring his deputies to take classes on the Constitution. You can read more about it here. I like the idea of local law enforcement understanding the very thing they are mandated to uphold. Equally enjoyable are the examples cited in the linked story of sheriffs threatening arrest of Feds if they didn't back down.
Some stupid FDA guy with a badge decided he was going to mess with Amish cow milk. The whole pasteurizing thing reared it's ugly head. Federal guy thinks he has authority on the sheriff's home turf. Due process and a local court search warranted is what was needed so the Fed blinked and lost the show down. Awesome

I like the idea of local law enforcement understanding the very thing they are mandated to uphold. Equally enjoyable are the examples cited in the linked story of sheriffs threatening arrest of Feds if they didn't back down.
Some stupid FDA guy with a badge decided he was going to mess with Amish cow milk. The whole pasteurizing thing reared it's ugly head. Federal guy thinks he has authority on the sheriff's home turf. Due process and a local court search warranted is what was needed so the Fed blinked and lost the show down. Awesome

Ex-NJ Cop Who Investigated Firearm Purchasers Dies in Street Racing Crash
This is not about someone's son's dying in a dumb car crash. We've all driven too fast and some of us have raced on public roads. Guilty as charged. This is about an institutional hypocrisy we have in the Garden State. North New Jersey reports:
So here is the ongoing problem I have with the supposed aura of deity surrounding the "only ones". My criticism rests on the jerk politicians who promulgate the idea of "only" police can be trusted with firearms. I haven't read why he was no longer a cop and as a 26 year old he wasn't on the job all that long. During his tenure he had super rights that the rest of us in NJ can not exercise. Yes I can have a gun but once I leave my property the freedoms are 100% removed. They are replaced with narrowly define exemptions for travel to a from a short list of destinations. Police on the other hand are totally exempt from NJ's unconstitutional firearm laws. Why? Because they are the only ones who can be trusted with guns. And therein lies the rub.
Again, this boy's memory and the grieving of his family is not my target. My problem is with the dumb laws and the equally dumb lawmakers and the infinitely stupid people in power over my civil rights. So please tell me, how the hell does a kid who races a BMW at over 100mph on Route 17 get to be more trustworthy with a gun than the rest of us? How the hell does this same youngster become the unaccountable bureaucrat deciding whether or not we can buy or own a gun? He was no better than millions of law abiding NJ citizens yet because he had a badge, this guy got superhero rights. Why? Because of all the training he received with firearms? Yet, this fellow died in a completely avoidable accident because he used terrible judgment. And your point is?
Cops are no better than the rest of us and should not have any more civil rights than the rest of us. This guy should have been able to get a handgun carry permit on his 21st birthday regardless of his profession. Just like I should be able. Civil rights do not cease to exist because we are not all police. That's stupid. This latest example of the vaunted "only ones" making the same mistakes as the rest of us illustrates that they are not a special breed of man exempt from the frailties of life. That argument left the station before it ever arrived.
And for those of you who think retired cops are treated any better than us (for the exception of actually being allowed to carry without having to show a justifiable need) then take a look at the NJSP link on all the crap they have to go through to keep their super rights. Interestingly hollow points and 15+ capacity magazines are verbotten as well as an age limit of 75 year old for this accommodation. I guess safer bullets, more bullets in a magazine and the inevitable murderous tendencies that kick in at 3/4 of century are too much of a giveback for lawmakers.

The other people who were in the car with Owens fled the scene after the crash and remained at large Saturday afternoon. Authorities say they found one gun at the shooting scene and another inside the getaway car, but further details on the weapons and the shooting were not immediately disclosed. This morning's deadly shooting is the second time in just weeks that carjackers have tried to hold up off-duty police officers in Newark. If We Can Save One Innocent Life by Banning Guns
What about the opposite. If we can save one life, can we have guns? Sarah Dawn McKinley seemed to think her life and the life of her baby was worthy of saving. Some of the numbskulls who would disarm everyone want us to call 911 and retreat. Well this young mother did just that. After 21 minutes of waiting for police to arrive, the stalker finally jimmied a door open and with a 12" knife in hand illegally entered her home. Good thing she waited for the bad guy to come on in before killing him with her shotgun. That way she had an unobstructed view of the creep and of course was well within her rights per OK law. Listen we don't know all the details of this guy and Sarah. She said she met him before and got a bad vibe. Why didn't the police show up in the 21 minutes it took for knife guy to finally break into her home? Did living in a trailer have anything to do with the delay? Was the PD handling a multitude of same "threat level" calls? Did 911 screw up? You decide. At least one young mother and her baby are alive and well. I guess guns aren't so bad after all, huh?
What's So Scary About Guns?
You walk into a room and there's a loaded gun on a table. It's in a holster with the safety on. Next to it are the keys to a Boeing 767 and 15 tubes of model glue (not the junk they sell now, the good stuff with the wicked vapors). Your heart begins to race, sweat moistens your forehead and your knees begin shaking. Why? Well of course it's the fear that someone will go crazy on glue fumes and go fly a plane into Giant's Stadium at half-time. Sniffojetaphobia is the clinical name. All too plausible if you ask me.
Phobias usually manifest visually or with a thought. If you are a-scared of cats your trigger may be seeing one enter the room. People who dream of cats call that a nightmare. Phóbos is funny foreign for morbid fear. Ooohhh. Sigmund Freud postulating that
That's kinda harsh, lumping the mentally challenged with firearm scardy cats. Someone from ARC better look into that. Hoplophobia is a word coined by Colonel Jeff Cooper which is defined as: noun, an irrational, morbid fear of guns (from the Greek hoplites, weapon;). Hoplophobia is too big and weird sounding for normal use. Me no like big scary word. How about we make up a new one.
For men, an appropriate word to describe the condition is testiclaphobia or it's close relative gonadaphobia. They are both nouns and could be defined as the fear of growing a pair. I don't want or need the ladies to go Hillary on us so they need their own word. For moms I'd go with shootaneyepoutaphobia in honor of Daisey. For all others something like ickaphobia. If it's loud or dirty, well you get the idea.
I can give all the ladies a pass. Moms and grandmoms can be irrational at the expense of protecting children. It's probably the only reason us neanderthals survived childhood. All the rest, just don't get into politics or law enforcement please. The men are a different story. You guys need to man up.
If you want dangerous guns and the bullets that kill people outlawed or legislated out of existence, you better check your pants. It's possible something is missing. Your problem is not firearms. It goes much deeper than that. Your fear is growing a pair. Yes they can be inconvenient. When they get smacked it hurts like hell. Sitting certain ways and riding a bicycle can be uncomfortable. It goes with territory. Here are some words of encouragement.
Your manhood will not appear like magic. This is not like buying a cape at the super hero store. Let's suppose you go in the woods with a card carry man and shoot at tin cans. They (your manhood) don't just drop down right away. That act just starts the physiology on its way. The responsible tutor shows you how to safely operate a plinking gun and let's you have some fun knocking stuff over. Maybe a dumb rat wanders by and you try to shoot it in the butt. These are all good first steps. When you're home later that day, go online and see how much that gun would cost to buy. You may feel something at this point.
Have someone explain how to apply for a FPID card at your local PD (NJ only). Get the paperwork and start figuring out who are your references and save up the money for all the fees. Ask your new best friend if you can go shooting again. Maybe he brings something different this time. More fun, more confidence, more lessons in safety. You're getting the hang of things. Go home and read a back issue of Shotgun News. You still can't see anything but you sure feel something forming.
Have your trusted guide take you to a gun show in PA. Walk around and look at all the cool stuff. Pay no never mind to some of the weird looking people. There are mutants in Greenwich Village as well. Odd people occupy all walks of life. Sorry, that's just the way it is. Buy a military surplus ammo can. They are way cool. When you pass the tables that let you sign up for the associations, stop and ask some questions. Take whatever literature and trinkets they have. Stuff them in the green metal box you just bought. Ask your buddy what kind of ammo runs in the hardware you've been shooting. You don't want to be a freeloader for ever. Buy a brick of 22's or a box of fifty 45acp. Throw that in the ammo can.
When you get home, lay the contents of your box on the bed and examine things. Boing, what was that? Hey it's a little crowded down there, what the . . . Next weekend hit the range or woods again and shoot some of your own ammo. Give some to the gun owner so he can shoot for free. Notice how you're beginning to understand the new culture. The words and descriptions are coming more natural. You feel more comfortable with firearms. Now go find the transcripts for Heller v. DC and read the majority opinion. It contains tons of history on the subject of the 2nd Amendment. You'll begin to nod your head in mental assent. Go back to the range and shoot some more. Go buy your first gun once dumb NJ gets around to issuing the equally stupid freedom pass. Make sure you get indignant at the pompous attitude of the idiot lawmakers that made it so difficult to buy a gun. Start supporting all the efforts that are trying to make your civil rights more like free America. Go join a gun club with shooting facilities. Be safe, be more safe, hell buy a safe to store your guns.
Congratulations, you've probably grown a pair. All this and you've found a new hobby, sport and freedom. Take another safety course, a self defense course, apply for a Florida concealed carry permit. Once you get it, go drive to Delaware or PA and strap that fire stick on. Go about your business in peace and in the confidence that you can defend yourself. Make sure you take it off and lock it up unloaded in the trunk before crossing back into NJ. Go take a hunter's safety course and hunt some deer or bear next winter. Have some delicious steaks and enjoy the new rug. Life is good.

NJ Gun Owners 01 / Stupid NJ Laws 00
Not really but it makes a decent headline. Chris Christie who has accomplished some remarkably conservative things is a 2nd Amendment dummy. Sorry to be the one to say it big fella' but your Bill of Rights record is terrible. He did however pledge that he would not be party to more firearm laws only to vigorously enforce the ones already on the books. So our gun laws suck and Christie won't make them worse by adding more. If he can be trusted the forward momentum of idiot lawmakers has been halted. I can live with that for now. Sometimes it's hard to counter-punch when your opponent is jabbing your face. I do however take issue with the Gov on his record of enforcing the laws as they stand.
Take for instance the 30 day maximum requirement for background checks. Local PD's and the NJSP are bound by law, you know, the one that Christie pledged to uphold. Since it only "kinda" is a violation of state law we have a normally raucous Gov without comment. He's a little church mouse.
The New Jersey Second Amendment Society has successfully reversed a firearm permitting policy in the hamlet of Little Egg Harbor. A NJ resident's ability to get papers (you need papers to exercise a civil right don't you know) is bad enough. It sucked further as rouge PD's burdened citizens with additional illegal paperwork. Ammoland.com is reporting that Little Egg Harbor required something called a "unlimited release of information and liability waiver as a condition of processing firearms permit applications." Why does this conjure images of trench coats and check points. Ve need to see if your papers are in order, ja. Well the good news is that town walked back the requirement and the goofy form is now an archive. NJ2AS didn't have to file their own papers in court to force compliance so this was a win for freedom in NJ.
Of course NJ is well behind free America so we have to take whatever victory we can get. Even though the stupid double and triple paperwork standard is overly burdensome, the least NJ could do is follow its own rules. The reason the Gov hasn't stepped in and reminded PD's and the NJSP to comply is simple. No one is forcing him to. Maybe we should shame him into upholding his own promise or at least the law. He seems to love the firearm laws as they are, OK then enforce them. Even the ones aimed at the government. He won't because as his own record shows, he hates private ownership of firearms. It appears that anything he can do to slow the process down and curtail the flow of guns into the state is a good thing. How can we come to any other conclusion? Not that more guns in the hands of law abiding citizens is bad, oh no no no. That is a great thing and we want to see more of it. It's just that Christie will not lift a finger to facilitate this commerce and is not interested in enforcing the law that clearly prohibits extra forms and 30 day maximum for issuance.
And another thing, can the Gov or anyone else out there cite one statistic that supports the notion that all this bureaucracy and excessive delay tactics have prevented one crime? Free America does one background check at the point of purchase. In NJ you get up to three for a handgun purchase. FPID card, Pistol Purchase Permit and a NICS at the dealer. Kinda like being stopped at a DWI checkpoint, driving 50 feet and having to go through another then 50 feet further yet another one. I guess they just want to be extra super certain that you are good to go. That or it's NJ's lust to make it as difficult as possible because they hate guns. Probably because they (including the Gov) hate guns .
